1. Acceptance of Terms
By accessing or using Melivaro ("the Service"), operated by Smart Technology Investments LLC ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time, and your continued use constitutes acceptance of any modifications.
2. Description of Service
Melivaro provides elective medical procedure cost optimization tools, including CMS fair price estimation, hospital charge comparison, cash-pay versus insurance analysis, medical tourism ROI calculation, and payment plan optimization. The Service uses publicly available data from CMS hospital price transparency files, Healthcare Bluebook, and Medicare reimbursement schedules.
3. Not Medical Advice
Melivaro is an informational tool and does not constitute medical advice, a diagnosis, or a recommendation for any specific medical procedure, facility, or provider. We are not a licensed healthcare provider, hospital, or insurance company. Actual procedure costs vary significantly by facility, provider, insurance plan, and clinical complexity. You should verify all pricing directly with your healthcare provider and insurer before making medical or financial decisions.
4. Intellectual Property
All content, algorithms, cost comparison models, and data compilations within the Service are the intellectual property of Smart Technology Investments LLC. You may not reverse engineer or extract the pricing optimization logic. Reports generated by the Service are licensed to you for personal use only.
5. Acceptable Use
You agree to use the Service only for lawful purposes related to personal healthcare cost research. You may not use the Service to generate misleading price comparisons for commercial solicitation or to facilitate insurance fraud. Automated scraping, credential sharing, and circumvention of rate limits are prohibited.
6. API Usage
Developer API access provides Layer 1 data including CMS procedure pricing, hospital chargemaster extracts, geographic cost indices, and financial assistance thresholds. Usage is subject to rate limits defined by your subscription tier. Redistribution of raw API data or use in competing products is prohibited.
7. Limitation of Liability
To the maximum extent permitted by law, Smart Technology Investments LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to incorrect cost estimates, unexpected medical bills, or decisions about medical procedures or facilities based on our analysis. Our total liability shall not exceed the fees you paid in the twelve months preceding the claim.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that hospital charges, CMS rates, or medical tourism pricing are current or error-free. Healthcare pricing varies widely and changes without notice.
9. Arbitration
Any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by JAMS in Los Angeles County, California. You waive your right to a jury trial and to participate in class action lawsuits. The arbitrator's decision shall be final and binding.
10. Governing Law
These Terms are governed by the laws of the State of California. Any litigation not subject to arbitration shall be brought exclusively in the courts of Los Angeles County, California.
